Before you file anything

A patent protects how an invention works, not what it is called. It has to be new, involve an inventive step and be capable of industrial application, and the claims have to be drafted narrowly enough to survive examination.

The most expensive mistake is disclosure. Presenting at a demo day, publishing a paper or launching publicly before filing can destroy novelty, so the provisional specification should go out before the announcement does.

Best suited to

  • Hardware and deep tech startups
  • Manufacturers with a novel process
  • Research teams filing before publication
  • Founders raising money on the strength of their technology

Documents you need

  • A technical description of the invention with drawings
  • Details of every inventor
  • PAN and address proof of the applicant
  • Udyam or startup recognition certificate if claiming reduced fees
  • Signed Form 26 authorising the patent agent
  • Any prior publication or disclosure details

Scanned copies are enough to begin. We check every document against the department's current format before filing, because a rejected form costs more time than a resubmitted scan.

Patent questions

What is the difference between a provisional and a complete specification?

A provisional specification secures your priority date while the invention is still being refined. The complete specification, with final claims, has to be filed within twelve months or the application lapses.

How long does a patent take in India?

Several years is normal. Publication happens after eighteen months from the priority date unless early publication is requested, and examination follows a request that has its own deadline.

Do startups get a fee concession?

Yes. Recognised startups, individuals and small entities pay reduced government fees. We check whether your Udyam or startup recognition qualifies before filing.

Should I publish my invention before filing?

No. Public disclosure before filing can destroy novelty. If you have already presented or published, tell us early, because there are limited windows that may still allow a filing.
