Why non profits choose section 8
A section 8 company is a not for profit registered under the Companies Act. Its income has to be applied to its objects, and no dividend can reach its members, which is exactly what a grant committee wants to see.
Compared with a trust or a society, it carries audited accounts and public filings with the MCA. That transparency is why CSR funders and institutional donors ask for it by name.
Best suited to
- Non profits applying for CSR funding from companies
- Education, healthcare and environment initiatives
- Organisations that want stronger governance than a trust or society
- Teams planning to apply for 12A and 80G later
Documents you need
- PAN and Aadhaar of every director and subscriber

Scanned copies are enough to begin. We check every document against the department's current format before filing, because a rejected form costs more time than a resubmitted scan.

Section 8 company questions
How is a section 8 company different from a trust or a society?
A section 8 company is registered with the MCA and follows the Companies Act, which means audited accounts and public filings. Donors and CSR committees usually prefer that level of disclosure over a trust deed or a society registration.
Can a section 8 company pay salaries?
Yes. It can pay reasonable salaries to staff and to directors who work in an executive capacity. What it cannot do is distribute profit or dividends to members.
Do we get 80G approval automatically?
No. Section 8 incorporation and income tax exemptions are separate. Registration under 12A and approval under 80G are applied for with the income tax department after the company exists.
Is there a minimum capital requirement?
No minimum paid up capital applies. What matters is that the projected activities and funding in the application are realistic and match the objects you are applying for.
