Governed by its members
A society is run by an elected governing body answerable to its members, which suits clubs, associations and organisations where the membership genuinely decides things. The memorandum sets the objects and the rules set how power changes hands.
It is state law, so the act, the registrar and the annual requirements change when you cross a border. A society intended to work nationally usually needs founding members drawn from seven different states, which is the condition applications most often fail on.
Best suited to
- Clubs, associations and resident welfare groups
- Educational and cultural organisations
- Charitable groups that want member based governance
- Bodies that need an elected governing council
Documents you need
- PAN and Aadhaar of every founding member
- Passport size photographs
- Address proof for each member
- Proof of the registered office with a no objection letter
- The proposed name and objects
- Details of the governing body and their designations
Scanned copies are enough to begin. We check every document against the department's current format before filing, because a rejected form costs more time than a resubmitted scan.

Society questions
How many members does a society need?
At least seven for a state level society. A society intended to operate at the national level generally needs seven members drawn from seven different states, which is a common reason applications get sent back.
What does a society file every year?
An annual list of the governing body members with the registrar, along with audited accounts where the state or the objects require it. The requirements differ by state.
Can a society be converted into a section 8 company?
There is no direct conversion. The usual route is to incorporate a section 8 company and transfer the activities and assets to it, which needs care on the tax and stamp duty side.
Does registration make donations tax deductible?
No. Registration under the Societies Registration Act and approval under section 80G of the Income Tax Act are separate. Donors can only claim a deduction once 80G approval is in place.
